Market Intelligence Agent (mia): A platform offering strategic market intelligence, competitor analysis, and growth signal tracking.
Availability: Services may be subject to updates, maintenance, or availability limits.
Beta/Trials: Some services may be offered in beta and are provided “as-is”.
3. User Responsibilities
- Provide accurate and updated information during onboarding
- Use services only for lawful, professional purposes
- Maintain confidentiality of credentials
- Avoid misuse, reverse-engineering, or data scraping
4. Intellectual Property
All intellectual property (IP) including code, models, visualizations, and designs remains the sole property of AureliaX Consulting B.V.
Users may not copy, distribute, or resell our platforms without written permission.
5. Payment & Subscriptions
- Pricing structures are available upon request
- Subscription auto-renewal terms apply unless canceled before the billing cycle
- Late payments may incur penalties or suspension of service
6. Termination
- Either party may terminate with written notice
- Upon termination, access ends and outstanding fees are due
- User data can be exported or deleted on request
7. Disclaimers and Limitations
- Services are provided “as-is” without warranties of performance
- mia is not liable for indirect damages or business losses
- No guarantee of accuracy or completeness of model outputs
8. Governing Law
These terms are governed by Dutch law.
Any disputes will be resolved under the jurisdiction of The Netherlands.
9. Modifications to the Terms
mia reserves the right to revise these Terms of Service at any time. Updated versions will be posted on our website with a revised “Last Updated” date. Continued use of our services after updates indicates acceptance of the modified terms.
10. Feedback and Suggestions
Any feedback, comments, or suggestions you provide may be used by mia without restriction or compensation to you. We appreciate your ideas and may incorporate them into our services.
11. Beta Features Disclaimer
Certain services may be marked as “Beta” or “Early Access”. These are offered on an as-is, no-guarantees basis and may be changed, removed, or improved without notice.
12. Account Suspension and Investigation
We may suspend or terminate accounts found violating these Terms, the AUP, or applicable law. Investigations may involve third-party authorities where necessary.
13. Force Majeure
mia shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, government actions, or cyberattacks.
14. Use of AI Disclaimer
Our product is powered by artificial intelligence. While insights are data-driven and designed for accuracy, they should not replace legal, financial, or strategic human judgment.
15. Acceptable Use Policy
- No reverse-engineering, scraping, or interference with platform functionality
- No storing or distributing illegal, discriminatory, or harmful content
- No spamming, phishing, or overuse of API calls
- Accounts exceeding fair use may be subject to throttling or review
- No training external AI models on our outputs or data
- No unauthorized probing, stress-testing, or security breaches
- No impersonation of other entities or fraudulent use of insights
- No use of the platform to generate or distribute disinformation
16. Data Processing Agreement (DPA)
For enterprise customers:
- Roles: mia acts as Processor; Client as Controller
- Subprocessors: Listed and regularly updated
- Requests: We respond to DSARs within legal timeframes
- Breach: Notification within 72 hours per GDPR
Types of Personal Data:
- Name, email address, job title
- Company name, industry, and CRM details
- Usage metrics and platform behavior
Security Measures:
- Data encryption (AES-256 at rest, TLS in transit)
- 2FA and IAM-based access control
- Real-time threat monitoring and audit logging
Subprocessors:
- AWS (Cloud infrastructure)
- Vercel (Frontend deployment)
- Mixpanel / Matomo (Product analytics)
- Customer.io / Hubspot (Communications)
17. Service Level Agreement (SLA)
Optional for enterprise clients
- Uptime: 99.5% monthly uptime commitment
- Support: Email response within 24h during business days
- Incidents: Clear escalation policy with status updates
